Taking the Vehicle outside Florida without prior written approval is a material breach. It voids all coverage — both any protection product bought through Amped and any coverage extended by your own policy — and you become responsible for all reasonable costs to recover the Vehicle and return it to Miami-Dade County: travel for our personnel or an agent, towing and transport, storage, Loss of Use for every day the car cannot be rented, administrative time, and collection or legal costs. Telling us the car is out of state does not transfer the obligation to bring it back. If the Vehicle is not redelivered at the end of the term, Florida Statutes §817.52(3) and §812.155 also apply — see Section 20. See Section 7(a).
Yes, at no extra charge, provided the return location is within 50 miles of Miami Gardens, Florida 33056 and inside the State of Florida. Pick up at a Miami Beach hotel and return at Fort Lauderdale airport, for example. There are no exceptions outside that area — not Orlando, Tampa, Jacksonville, the Panhandle, or any location outside Florida. A return attempted outside the service area is treated as a failure to redeliver. See Section 4(f).
Two Florida statutes apply. Under §817.52(3), abandoning or willfully refusing to redeliver a hired motor vehicle at the end of the rental term, with intent to defraud, is a third-degree felony. Under §812.155, Amped may serve written demand for return by certified mail with return receipt requested or by tracked courier to the Notice Address given at booking; failure to redeliver within 5 days of that demand is prima facie evidence of abandonment or refusal to redeliver. All recovery costs under Section 7(a) apply in addition. See Section 20.
Every rental must carry comprehensive and collision coverage — a vehicle cannot be released without it. If your own auto policy carries both and extends to rentals, you pay nothing extra; it is verified through Canopy Connect before delivery, your declarations page must show both coverages with active dates, and the named insured must match the renter. Otherwise Bonzah Standard Protection at $50.13 per day is added at checkout. Florida law separately requires liability and personal injury protection coverage. See Section 9.
Delivery and collection are free on rentals of 7 days or more within 50 miles of Miami Gardens, Florida 33056. On rentals shorter than 7 days a flat $120 covers both the drop-off and the collection. Amped delivers to MIA and FLL airports, PortMiami and Port Everglades, hotels, Airbnbs, offices and homes across Miami-Dade, Broward and Palm Beach. See Section 4.
Under Florida Statute §322.38, a rental company may not rent to anyone who is not duly licensed, and must inspect the driver license and verify that it is unexpired. The company must also keep a record of the vehicle’s registration number, the renter’s name and address, the license number, and where the license was issued — open to inspection by law enforcement. For delivery-only and contactless rentals, §322.38(4) allows that verification to be completed in advance at booking. Amped Auto Rentals verifies through Vouched before delivery. See Section 6(b).
Under Miami-Dade County Code §8A-1.1, a rental car company must make crash-tested child restraint devices available for rent for children aged 5 or under and disclose the details and cost; must disclose information and cost for toll processing; and must make available a visitor information map and safety tips to county standards. Amped Auto Rentals supplies a child safety seat for $10 per day, fits every vehicle with an active SunPass transponder at no charge with tolls billed at cost and no admin fee, and sends the county visitor safety tips electronically with your booking — available in English, Spanish, French, Portuguese, Italian or German. See Section 20.
"Agreement" means these Terms & Conditions and any booking confirmation, rental invoice, or face page provided to you at time of booking.
"You" / "Your" means the person identified as the renter, any person signing this Agreement, any Authorized Driver, and any person or organization to whom charges are billed. All such persons are jointly and severally bound.
"We" / "Our" / "Us" / "Amped" means Amped Auto Rentals, a registered Fictitious Name (DBA) of Clear, Bright & Smart Diversified Holdings LLC, a Florida limited liability company.
"Vehicle" means the motor vehicle we deliver to you under this Agreement, including all tires, accessories, equipment, keys, charging cables, adapters, and vehicle documents.
"Authorized Driver" means only the renter and any additional driver we have expressly approved in writing prior to the rental. Authorized Drivers must be at least 21 years of age and hold a valid, current driver's license throughout the rental period.
"Unauthorized Driver" means any person who operates the Vehicle other than an Authorized Driver. Operation by an Unauthorized Driver voids all coverage and makes you fully liable for all resulting damage, loss, and liability.
"Loss of Use" means our inability to rent the Vehicle while it is being repaired or is unavailable due to damage, calculated at the Vehicle's daily rental rate multiplied by the number of days out of service.
"Diminished Value" means the difference between the Vehicle's fair market value immediately before damage and its value after repair.
"Cardholder" means the individual whose name appears on the credit or debit card used to pay for or secure a rental. Where the Cardholder is a different person than the verified renter, both are jointly and severally liable for all charges under this Agreement.
"Credit Card Authorization Form" means the Amped Auto Rentals form required on every rental under Section 6(c), completed by hand and signed by the Cardholder, together with its required attachments.
"Statement Descriptor" means the name appearing on your credit card or bank statement identifying a charge from Amped. Charges will appear as AMPED AUTO RENTALS and/or CLEAR BRIGHT & SMART DIVERSIFIED HOLDINGS LLC. By completing a booking, you acknowledge these descriptors and agree that any charge appearing under either name is authorized under this Agreement.
"Notice Address" means the mailing address you provide at booking. You agree to provide and maintain a current mailing address, and you agree that this is the address at which any demand for return of the Vehicle under Florida Statute §812.155 and any other legal notice may be served on you. Amped is also required to record your address under Florida Statute §322.38(3).
"Booking Confirmation" means the email and/or SMS receipt sent to you upon completing your booking, itemizing all charges and the deposit amount.
"SMS Program" means the Amped Auto Rentals SMS Program, the text-messaging service described in Section 17 through which we send transactional and promotional SMS messages to consenting customers.
Amped Auto Rentals is a 100% delivery-only EV and mixed-fleet vehicle rental service. Amped Auto Rentals is a registered Fictitious Name (DBA) of Clear, Bright & Smart Diversified Holdings LLC, a Florida limited liability company based in Miami Gardens, Florida. We are accredited by the Better Business Bureau and serve Miami-Dade, Broward, and Palm Beach counties with the Tesla Model Y, Tesla Model 3, Chevrolet Equinox EV, Nissan Pathfinder, and Nissan Rogue.
We deliver directly to your location through our South Florida delivery service. We do not operate a physical rental counter, storefront, or walk-in location.
We reserve the right to modify, reject, or cancel any booking. If we cancel a confirmed, paid booking for reasons not caused by your breach, you will receive a full refund. We make no warranties, express or implied, regarding the Vehicle.
You acknowledge that the Vehicle may be equipped with GPS tracking, telematics systems, event data recorders, and/or video/audio recording systems (including dashcam and Sentry Mode on Tesla vehicles). We may use these systems to locate, monitor, or remotely access the Vehicle as we deem necessary, without prior notice, to the fullest extent permitted by law.
If you connect your smartphone or other device to the Vehicle's infotainment system, you are solely responsible for unpairing your device and deleting all personal data from the Vehicle's systems before returning it.
You consent to our collection and use of vehicle telematics data — including location, speed, battery level, odometer readings, and diagnostic data — for fleet management, mileage tracking, and enforcement of this Agreement.
Telematics as Evidence: GPS coordinates, timestamps, odometer records, and vehicle operation logs constitute authoritative, tamper-evident evidence of vehicle delivery, operation, and return. This data will be submitted in response to payment disputes, chargebacks, or legal proceedings.
We deliver to Miami, Miami Beach, Fort Lauderdale, Hollywood, Miami Gardens, Wynwood, and Boca Raton & Delray Beach.
Service area. Amped Auto Rentals delivers to any address within 50 miles of Miami Gardens, Florida 33056, across Miami-Dade, Broward and Palm Beach counties. This includes Miami International Airport (MIA), Fort Lauderdale-Hollywood International Airport (FLL), PortMiami and Port Everglades, hotels, Airbnbs, offices and private residences. Delivery outside the 50-mile service area is not offered.
Delivery fee. Delivery and collection are free on rentals of 7 days or more within the 50-mile service area. On rentals shorter than 7 days a flat $120 delivery fee applies, covering both the delivery and the collection. Delivery to a cruise terminal is arranged in advance and may be curbside or at a nearby garage depending on terminal access on your sailing date.
An Authorized Driver must be present at the agreed delivery location and time. We will conduct a brief vehicle orientation, approximately 10 minutes.
Vehicle condition is recorded at delivery on the Amped Auto Rentals Vehicle Condition Report and supported by time-stamped photographs. You are responsible for inspecting the Vehicle and noting any pre-existing damage on that report before our driver departs. Damage not recorded on the Vehicle Condition Report at delivery will be treated as having occurred during your rental. You will be given a copy of the completed report.
The same report is completed again at collection, recording odometer, battery level, condition and accessories returned, and is supported by time-stamped photographs. Where you are not present at collection, our driver completes the report and photographs the Vehicle, and a copy is emailed to you the same day.
If no Authorized Driver is present within 30 minutes of the scheduled time, a $50 no-show fee applies per 30-minute increment. After 60 minutes with no contact, we may cancel the delivery with no refund for that rental day.
You must make the Vehicle available for retrieval at the agreed location and time, in the same condition as delivered (ordinary wear excepted). All keys, charging cables, adapters, and accessories must be returned.
If the Vehicle is not made available within 1 hour of the scheduled return time without prior notice, a $30 late fee applies. Delays exceeding 3 hours are billed as a full additional rental day.
Extensions are subject to availability and must be confirmed by Amped before your scheduled return. Unauthorized retention may be treated as failure to redeliver under Florida Statutes §817.52(3) and §812.155 — see Section 20.

You may return the Vehicle to a different address from the one it was delivered to, at no additional charge, provided the return location is within 50 miles of Miami Gardens, Florida 33056 and within the State of Florida. On rentals shorter than 7 days the $120 delivery fee covers both the delivery and the collection; on rentals of 7 days or more, both are included at no charge.
No exceptions. Amped does not accept returns outside the 50-mile service area under any circumstances — including but not limited to Orlando, Tampa, Jacksonville, the Florida Panhandle, or any location outside the State of Florida. A return attempted outside the service area is a failure to redeliver under Section 4(c) and a material breach under Section 7(a), and all recovery costs under Section 7(a) apply.
You are responsible for all damage to, and loss or theft of, the Vehicle from the time of delivery until it is retrieved by us — whether or not you are at fault — including damage caused by collision, weather, road conditions, and acts of nature.

You must report all accidents, theft, and vandalism to us and to local law enforcement immediately upon discovery. Failure to report may void any applicable coverage.
You are solely responsible for all tolls, parking citations, red light camera fines, traffic violations, court costs, and related penalties incurred during your rental. If we receive and pay a citation on your behalf, you agree to reimburse us for the full amount plus a $50 administrative fee per incident.
By booking with Amped Auto Rentals, you consent to identity verification — including your driver's license, date of birth, and payment method — as a condition of your rental. We use Vouched, a third-party identity verification service. Renter must be at least 21 years of age and must have held a valid driver's license for at least 2 years. Renters aged 21–24 may be subject to a young driver surcharge, disclosed at booking.
Florida Statute §322.38 governs the rental of a motor vehicle to another person. Amped may not rent to anyone who is not duly licensed, or — if a non-resident — licensed under the laws of their state or country of residence. Before delivery, Amped inspects your driver license and verifies that it is unexpired.
Contactless verification. Because Amped is a delivery-only service and you may take possession of the Vehicle without direct contact with an Amped agent, verification is completed in advance through Vouched at the time you book or enroll, as contemplated by §322.38(4). Completing that verification is a condition of delivery. A Vehicle will not be released until it is complete.
Records we are required to keep. Under §322.38(3), Amped keeps a record of the registration number of the Vehicle rented, your name and address, your driver license number, and the place where your license was issued. This record is open to inspection by any police officer or by an officer or employee of the Florida Department of Highway Safety and Motor Vehicles. You agree to provide accurate information for this purpose and to keep your address current for the duration of the rental. The address you provide is your Notice Address as defined in Section 1.
The payment card used to book or secure a rental must be a card the renter is legally authorized to use. By submitting a payment card, you represent and warrant that you are either the named Cardholder or an authorized user of that card.
Third-Party Card Liability: If the payment card belongs to a person other than the verified renter, both the renter and the Cardholder are jointly and severally liable for all charges under this Agreement. The renter's completed identity verification constitutes conclusive proof that the renter knowingly accepted our services, irrespective of whose card was charged.
Fraud Representation: You represent that no charge made under this Agreement is or will be fraudulent. Filing a chargeback claiming "fraud" or "no knowledge of this charge" on a rental for which identity verification was completed, a rental agreement was signed, and a vehicle was delivered and operated, is a materially false representation.
A completed Amped Auto Rentals Credit Card Authorization Form is required on every rental, without exception, whether or not the Cardholder is the renter. Completion and acceptance of that form is a condition precedent to release of the Vehicle. No Vehicle will be delivered until the form and all required attachments have been received and verified by Amped.
What is required. The form must be printed, completed by hand, and signed by hand. Typed, electronically signed, or digitally completed forms are not accepted. Return the completed form and attachments to [email protected] at least 24 hours before your scheduled delivery, or hand them to the Amped delivery driver at the vehicle handover. The form must be accompanied by:
Third-party payment. Where the Cardholder is not the person taking delivery of the Vehicle, Section 5 of the Credit Card Authorization Form must be completed in full, identifying the Authorized Renter by name, date of birth, driver license number and contact details, and must be signed by both the Cardholder and the Authorized Renter. By signing, the Cardholder accepts joint and several liability with the Authorized Renter for all charges and incidentals arising from the reservation, as provided in Section 1 ("Cardholder") and Section 6(a) above.
Key Rental Terms. Section 9 of the Credit Card Authorization Form, Key Rental Terms, is initialled and signed by the person who will drive the Vehicle. Where the Cardholder and the driver are the same person, that person completes it. Where they are different people, it is completed by the driver at delivery.
Security and data handling. Amped does not request, record or retain full payment card numbers or card security codes in any form. Any document received showing a full card number or a security code will be destroyed and a compliant copy requested before the Vehicle is released. Identity documents and card copies are retained securely and are used solely for identity verification, statutory recordkeeping under Fla. Stat. §322.38(3), and the defence of payment disputes and claims. See our Privacy Policy for the retention period.
Prohibited use voids all coverage, makes you fully liable for all resulting damage or loss, and constitutes a material breach of this Agreement — including forfeiture of any refund.
The following uses of the Vehicle are strictly prohibited:
The Vehicle must remain within the State of Florida for the entire rental period. Operation outside Florida without Amped's prior written approval is a material breach of this Agreement and voids all coverage, including any protection product purchased through Amped and any coverage extended by your personal auto policy.
Recovery costs. If the Vehicle is taken outside the State of Florida without prior written approval, or is not made available for retrieval at the agreed location within Florida, you are responsible for all reasonable costs and fees incurred by Amped to recover the Vehicle and return it to Miami-Dade County, Florida, including but not limited to:
These costs are in addition to, and not limited by, the $250 security deposit and any other charges due under this Agreement. You authorize Amped to charge your payment method on file for these amounts as they are incurred.
Location data. You acknowledge that the Vehicle is equipped with telematics as described in Section 3, that Amped may use that data to locate and recover the Vehicle at any time, and that GPS records constitute authoritative evidence of the Vehicle's location for the purposes of this Section.
Return to Florida is your obligation. Notifying Amped that the Vehicle is outside Florida does not transfer the obligation to return it. The Vehicle must be returned to the agreed location within Florida at your cost. Failure to do so is a failure to redeliver, addressed under Florida Statutes §817.52(3) and §812.155 as set out in Section 20.
Return the Vehicle with battery charge at or above the delivery level (minimum 80%). Vehicles returned below this level incur fees as follows:

You are solely responsible for all public or private charging station fees during your rental, including idle fees and session charges.
Tesla Supercharger access is permitted subject to Tesla's Terms of Service. Supercharger fees are billed by Tesla to Amped and will be invoiced to you after your rental concludes — these charges may not appear on your initial invoice. Lost or damaged key cards/fobs incur a replacement fee of up to $300 plus service costs.
Do not install Vehicle software updates unless specifically instructed by Amped. Unauthorized software updates are at your sole risk.
EVs must not be towed with drive wheels down. Contact Amped immediately if towing is needed.
EV range estimates are approximate. It is your responsibility to ensure the Vehicle has sufficient charge to reach a charging station or the return location.
All rentals include 300 miles per day. Miles over the daily allowance are charged at the per-mile overage rate disclosed at booking.
Unlimited Mileage Add-On: A flat $59 per rental, selected at booking. Cannot be added after the rental begins. No per-mile overage charges once added. Vehicles must remain within Florida regardless of mileage option.

Every rental must carry comprehensive and collision coverage. Amped cannot release a Vehicle without it. You may satisfy this requirement in either of two ways.
Option 1 — your own policy. If your personal auto policy carries both comprehensive and collision coverage and extends to non-owned rental vehicles, it acts as primary coverage for the rental and there is no additional charge. Amped verifies this through Canopy Connect before delivery. Your declarations page must show both coverages with active dates covering the full rental period, and the named insured must match the renter on the booking. An insurance card alone is not sufficient. Where your own policy is used, a claim is made through your insurer and your deductible applies.
Option 2 — Bonzah protection. If you do not hold qualifying comprehensive and collision coverage, Bonzah Standard Protection is added at $50.13 per day and purchased at checkout. Coverage terms, limits and exclusions are set by Bonzah and should be reviewed before purchase. Bonzah protection is required in this circumstance and is not optional.
If verification cannot be completed, or your proof does not show both coverages, Amped will contact you to add protection before delivery. A Vehicle will not be released without one of the two options in place.
You also agree to maintain personal auto liability insurance during your rental providing primary coverage for bodily injury and property damage liability, and personal injury protection (PIP) as required by Florida law.
FOR FLORIDA RENTALS: The valid and collectible liability insurance and personal injury protection insurance of any authorized rental driver is primary for the limits required by Florida Statutes §§ 324.021(7) and 627.736.
Payment is due in full at time of booking. By submitting payment and completing your booking, you expressly authorize Amped Auto Rentals to charge your payment method for the full rental amount, the $250 security deposit pre-authorization, all additional charges incurred during or after your rental, and post-rental charges — including Tesla Supercharger sessions, toll invoices, traffic citations, mileage overages, and damage assessments — which may be billed days or weeks after your return date.
Upon booking, you receive a Booking Confirmation via email and/or SMS itemizing all charges. Any claim of "no knowledge" of a charge described in the Booking Confirmation is without merit. Service is deemed rendered at the moment the Vehicle is delivered to your location. No refund of the base rental amount is available on grounds of "not received" once delivery has occurred.
Initiating a chargeback for services that were rendered constitutes a material breach of this Agreement and may constitute fraud. Before initiating any payment dispute with your bank or card issuer, you must first contact Amped at [email protected] or (786) 981-1177 and allow us 5 business days to resolve the concern.
Filing a fraudulent or bad-faith chargeback entitles Amped to pursue all available legal remedies including recovery of the disputed amount, administrative costs, collection fees, and attorney's fees.
If you block, cancel, dispute, or otherwise render your payment card unavailable after a rental has commenced or concluded, such action constitutes a material breach. Amped may pursue: civil action in Miami-Dade County Small Claims Court; referral to a third-party collections agency with credit bureau reporting; demand letters and attorney engagement; and interest on unpaid balances at the maximum rate permitted under Florida law after 30 days of written demand.
Blocking your card does not eliminate the debt. It changes how we collect it.

At time of booking or delivery, we pre-authorize a $250 security deposit against your credit or debit card. This is a temporary hold — not a charge. If no incidentals are incurred, the full $250 hold is released 3–7 business days after return.
What the Security Deposit Covers: Tesla Supercharger sessions, tolls (SunPass / E-ZPass), traffic citations plus the $50 admin fee, mileage overages, vehicle damage, extraordinary cleaning (up to $300), smoking/vaping fee ($400), late return fees, EV battery recharging fees, lost or unreturned accessories, and any other fees or charges incurred under this Agreement.
Post-Rental Billing: Tesla Supercharger fees, toll invoices, and traffic citations may be billed to Amped days or weeks after your rental ends. You authorize us to charge your card on file for these amounts when received, even after the deposit hold is released.
If incidentals exceed $250, the excess will be charged separately to your payment method. The deposit amount does not limit your total financial responsibility under this Agreement.
All cancellations must be submitted in writing to [email protected] or through the booking platform. Refunds processed within 3–5 business days.

No refund for unused days unless you notified Amped at least 24 hours before the original return date and received written confirmation. Approved early returns refunded at the daily rate for each full unused day, minus a $25 administrative fee.
If Amped cancels a confirmed booking due to reasons not caused by your breach, you receive a full refund within 5 business days, including any delivery fee paid.
Exceptions may be considered at Amped's sole discretion for documented flight cancellations, hospitalization, natural disasters, or extraordinary events. Submit requests with supporting documentation within 48 hours of cancellation to [email protected].
Our services may involve third-party platforms including Turo, insurance providers, Vouched identity verification, payment processors, and SMS delivery providers. We are not responsible for the content, quality, or availability of third-party services. Please review their terms independently before use.
You release Amped, our agents, and employees from all claims for loss of or damage to personal property left in the Vehicle during the rental period. This includes digital data stored on or transmitted through the Vehicle's infotainment system. Check the interior thoroughly before returning the Vehicle.
All content on our website — including text, images, logos, blog articles, and documents — is the exclusive property of Amped Auto Rentals. You may not reproduce, distribute, or use our content without written permission.
To the fullest extent permitted by Florida law, Amped, its directors, officers, agents, employees, and affiliates shall not be liable for any indirect, consequential, special, incidental, or punitive damages arising from your use of our services, even if advised of the possibility of such damages.
Except where prohibited by law, you agree to indemnify and hold harmless Amped and its affiliates from all claims, liabilities, damages, and legal fees arising from: (a) your use of our website or services; (b) your violation of this Agreement; (c) your operation of the Vehicle; or (d) any Unauthorized Driver's operation of the Vehicle.
Consumer Rights: Where mandatory consumer protection law applies and cannot be excluded, your statutory rights remain unaffected by these Terms.
Program Name: Amped Auto Rentals SMS Program.
You may consent to receive SMS messages from Amped Auto Rentals through one of three separate opt-in methods. In every method, consent for MARKETING SMS is collected SEPARATELY from consent for TRANSACTIONAL SMS via a distinct, unchecked-by-default checkbox or opt-in action. Consent to receive marketing SMS is not a condition of any purchase or rental.
Method 1 — SMS Sign-Up Page (Primary).
Visit ampedautorentals.com/sms-signup and complete the form. You select consent via two separate checkboxes: (A) "Booking & Service Messages" (transactional, service-related, checked by default); and (B) "Promotions & Special Offers" (marketing, labeled Optional, unchecked by default, and not required to submit the form).
Method 2 — Direct Booking Checkout.
When completing a direct booking at book.ampedautorentals.com, you consent only to TRANSACTIONAL SMS messages required to perform your rental — booking confirmations, delivery coordination, driver arrival notifications, pickup reminders, return logistics, and customer service replies. Marketing SMS consent is NOT collected at checkout.
Method 3 — Keyword Opt-In.
Text SUBSCRIBE or START to (786) 981-1177. The inbound message is stored as your consent record and the system auto-replies with a compliant confirmation identifying Amped Auto Rentals as the sender.
Messages sent under the Amped Auto Rentals SMS Program include:
You confirm that you are the authorized user of the mobile phone number and email address you provide. Consent is specific to the Amped Auto Rentals SMS Program and is not shared, sold, or repurposed. Mobile numbers are never purchased from third-party lists.
If you book a vehicle from Amped Auto Rentals through the Turo platform, Turo's Terms of Service govern your relationship with Turo and authorize Amped Auto Rentals, as the vehicle host, to contact you via SMS, email, or phone for trip-related purposes — including booking confirmation, delivery coordination, driver dispatch, return logistics, and customer service. These transactional messages are necessary to perform the rental services you have booked.
Promotional and marketing SMS messages are not sent to Turo guests based on their Turo booking alone. To receive promotional SMS from Amped Auto Rentals, a Turo guest must separately opt in through Method 1 or Method 3 above.
Message frequency varies. Marketing messages are limited to up to 6 per month if you opt in. Transactional messages have variable frequency based on your booking activity — multiple messages per booking during active delivery and return coordination, and occasional account or service messages as needed.
Message and data rates may apply. Amped Auto Rentals does not charge a fee for messages sent or received under this program, but your mobile carrier's standard message and data rates will apply based on your wireless plan.

To stop receiving text messages from Amped Auto Rentals at any time, reply STOP to any SMS message you receive from us. After you reply STOP, you will receive one final confirmation message and will not receive further marketing or promotional SMS messages from this program.
Note on transactional messages after opt-out: If you opt out of marketing messages but have an active or pending rental, you may still receive transactional SMS messages directly related to that rental, because these messages are necessary to perform the rental services you have booked.
The Amped Auto Rentals SMS Program is supported on all major U.S. wireless carriers, including but not limited to AT&T, T-Mobile, Verizon Wireless, Sprint, U.S. Cellular, Boost Mobile, Cricket, MetroPCS, and Virgin Mobile. Carriers are not liable for delayed or undelivered messages.
Your consent to receive SMS messages from Amped Auto Rentals is not a condition of any purchase or rental. Mobile phone numbers and SMS consent records are collected and stored in accordance with our Privacy Policy.
Amped Auto Rentals may modify or discontinue the SMS Program at any time without notice. Continued participation after changes constitutes acceptance of the updated terms. Changes will be reflected on this page and dated in the Last Revised header above.
You and Amped agree to resolve all claims, disputes, or controversies — including those arising from this Agreement, our services, charges, vehicles, or any rental — through binding individual arbitration rather than in court, except as stated below.
Either party retains the right to bring an individual action in small claims court, and either party may seek emergency injunctive relief in court to preserve the status quo pending arbitration.
Arbitration shall be conducted under the American Arbitration Association (AAA) Consumer Arbitration Rules, available at www.adr.org. The arbitrator's decision shall be final and binding. This arbitration agreement is subject to the Federal Arbitration Act.
Before initiating arbitration, both parties agree to provide written notice of the claim at least 30 days in advance and make a good-faith effort to resolve the dispute informally.
Notice to Amped: [email protected] or certified mail to our registered agent. Notice to you will be sent to the address on file in your booking.
No settlement demand or offer made prior to formal proceedings may be used as evidence or admission of liability in any subsequent proceeding.
FAILURE TO RETURN A HIRED VEHICLE — FLORIDA STATUTE §817.52(3). Under Florida Statute §817.52(3), a person who, after hiring a motor vehicle under an agreement to redeliver it to the owner or the owner's agent at the termination of the rental period, without the owner's consent and with intent to defraud, abandons or willfully refuses to redeliver the vehicle as agreed, commits a felony of the third degree, punishable as provided in §§775.082, 775.083 or 775.084, Florida Statutes. Under §817.52(2), absconding without paying or offering to pay the hire is prima facie evidence of fraudulent intent.
FAILURE TO RETURN RENTAL PROPERTY — FLORIDA STATUTE §812.155. The following statutory notice is reproduced verbatim as required by §812.155(6):
Failure to return rental property or equipment upon expiration of the rental period and failure to pay all amounts due (including costs for damage to the property or equipment) are evidence of abandonment or refusal to redeliver the property, punishable in accordance with section 812.155, Florida Statutes.
Acknowledgment. You acknowledge the statement above at the time of booking. Your acknowledgment is recorded and timestamped with your Booking Confirmation.
Demand for return. If the Vehicle is not made available at the end of the rental period, Amped may make written demand for return by certified mail with return receipt requested, or by courier service with tracking capability, addressed to your Notice Address as defined in Section 1. Under §812.155, failure to redeliver the Vehicle within 5 days of receipt of that demand — or within 5 days of delivery by courier or return receipt from the certified mailing — is prima facie evidence of abandonment or refusal to redeliver. Notice sent to the Notice Address is sufficient and equivalent to notice received, even if returned undelivered. Email may be used as an additional channel but does not replace the statutory method.
FRAUDULENT USE OF A CREDIT CARD — FLORIDA STATUTE §817.61. Under Florida Statute §817.61, a person who, with intent to defraud, obtains money, goods, services or anything else of value by representing without the consent of the cardholder that he or she is the holder of a specified card violates that section. Where, in any six-month period, the card is so used more than two times or the value obtained is $100 or more, the offence is a felony of the third degree. Amped Auto Rentals reports suspected fraudulent card use, with the complete evidence file described in Section 6(c), to the issuing bank, the payment card network and law enforcement. Amped may also bring a civil action under Florida Statute §772.11 for threefold its actual damages, plus attorney's fees and court costs, following written demand as that section requires.
CHILD RESTRAINT DEVICES — FLORIDA STATUTE §316.613 AND MIAMI-DADE CODE §8A-1.1. Florida Statute §316.613 requires every operator transporting a child aged 5 or under to properly use a federally approved child restraint device. Miami-Dade County Code §8A-1.1 requires rental car companies to make crash-tested child restraint devices available for rent and to disclose the details and cost, either at the rental facility or as part of the rental agreement. Amped Auto Rentals provides a Safety 1st Grow & Go convertible child safety seat for $10 per day, subject to availability. Request it at the time of booking; a seat cannot be guaranteed if requested after your rental has begun. The seat is delivered with the Vehicle and installed at your direction. You remain responsible for verifying correct installation and for complying with §316.613 throughout the rental.
TOLL PROCESSING AND SUNPASS — MIAMI-DADE CODE §8A-1.1. Miami-Dade County Code §8A-1.1 requires rental car companies to disclose information and cost regarding toll processing. Every Amped Auto Rentals vehicle is delivered with an active SunPass transponder already installed at no charge. There is no daily transponder fee, no per-toll administrative fee and no toll package to purchase. Tolls incurred during your rental are billed to you at cost after the Vehicle is returned, with no markup. Miami expressways — including the Dolphin (SR-836), Airport Expressway (SR-112), Don Shula (SR-874), Snapper Creek (SR-878) and Gratigny Parkway (SR-924) — are all-electronic and accept no cash. Do not attach your own transponder to the Vehicle: doing so can cause a toll to be billed twice. Traffic citations and red light camera fines remain your responsibility under Section 5(a) and carry a $50 administrative fee per incident.
VISITOR INFORMATION AND SAFETY TIPS — MIAMI-DADE CODE §8A-1.1. Miami-Dade County Code §8A-1.1 requires rental car companies to make available a visitor information map and safety tips meeting Miami-Dade County standards. Because Amped Auto Rentals is a delivery-only service with no rental facility, this material is provided to you electronically with your Booking Confirmation and again at delivery. Miami-Dade County publishes its visitor safety tips in English, Spanish, French, Portuguese, Italian and German; tell us at booking which you prefer and we will send that version. Printed copies are available on request at no charge.
Governing Law. Florida law governs this Agreement without regard to conflict-of-law provisions.
Severability. If any provision is found invalid or unenforceable, it will be severed and all remaining provisions continue in full force.
Modifications. No term may be waived or modified except by a writing signed by an authorized Amped representative.
Entire Agreement. This Agreement constitutes the entire agreement between you and Amped regarding your rental. All prior representations are superseded.
Changes to These Terms. We may update these Terms at any time. Changes will be posted on our website. Continued use constitutes acceptance. See our Privacy Policy for data handling practices.
